How Livo ChatBot handles digital personal data under India's Digital Personal Data Protection Act, 2023 (DPDP Act), including Data Principal rights and grievance redressal.

This policy is a draft starting point and has not been reviewed by a lawyer — if you are relying on it for compliance, please have it reviewed before publishing. The Grievance Officer section below needs a real named individual filled in before publishing; it currently only points at our general support contact.
This policy explains how Livo ChatBot (operated by Loginfotech) handles digital personal data under India's Digital Personal Data Protection Act, 2023 ("DPDP Act"). It supplements, and does not replace, our general Privacy Policy.
Under the DPDP Act, the person or organisation that decides why and how personal data is processed is the Data Fiduciary, and the individual the data belongs to is the Data Principal. For a customer's own account, Loginfotech is the Data Fiduciary. For the personal data of a customer's website visitors (collected through their chatbot), our customer is the Data Fiduciary and Livo ChatBot acts as a Data Processor on their instructions — the same controller/processor distinction described in our Privacy Policy.
Where a website visitor submits personal data through a chatbot's pre-chat form or during a conversation, that submission is treated as the visitor's consent to that specific collection, for the specific purpose of being able to respond to them and follow up. The chatbot owner (our customer) is responsible for ensuring the chatbot's data collection on their site is clearly disclosed to their own visitors, consistent with the DPDP Act's notice requirements.
Under the DPDP Act, you have the right to:
To exercise any of these rights, contact us using the details in Section 7.
We retain personal data only as long as necessary for the purpose it was collected, or as required under applicable law (e.g. billing/tax records). Our infrastructure is hosted in India. The DPDP Act permits transfer of personal data outside India except to countries specifically restricted by the Central Government — as of this policy's last update, no such restriction list has been notified.
Livo ChatBot is not designed to knowingly collect personal data from children or persons with disability who have a lawful guardian, and does not itself verify the age of chat visitors. If you operate a chatbot on a website directed at children, you are responsible for obtaining verifiable parental/guardian consent as required under the DPDP Act before collecting any personal data from them.
